Legal battle goes public

On May 11, The Cultural Landscape Foundation and its founder Charles A. Birnbaum sued the Department of the Interior and the National Park Service, alleging the Reflecting Pool was repainted a "vivid blue" without following required Congressional procedures. The complaint argues the change alters the pool's historic character and that consulting parties were not notified or given a chance to participate.

Why preservationists are alarmed

The Reflecting Pool is listed in the National Register of Historic Places and has hosted landmark moments, including Martin Luther King Jr.’s 1963 "I Have a Dream" speech. The suit cites the National Historic Preservation Act, saying consultation must happen before work on historic sites. Birnbaum warned a blue-tinted basin undermines the intended solemn, reflective effect and likened it to a resort or theme park.
